Data Storage Subscription Terms

Introduction and Scope
Purpose
These Data Storage Subscription Terms ("Storage Terms") govern your enrollment in Mosaic Biodata Inc.'s ("Mosaic," "we," "us," or "our") data storage subscription service. These Storage Terms supplement and are incorporated into our Terms of Service, Privacy Policy, Kit Order Terms and Conditions, and Genetic Data Consent Notice.
Service Description
The data storage subscription provides:
Secure cloud storage of your VCF (Variant Call Format) file
Unlimited viewing and downloading access to your genetic data
Continuous access to all lifestyle reports
24/7 account access through our platform
Eligibility
To subscribe, you must:
Be at least 18 years of age or have parental/guardian consent.
Have completed whole-genome sequencing through Mosaic Biodata Inc.
Maintain an active account with current contact information.
Have a valid payment method on file

Subscription Service Details
Monthly Subscription - $5.00/month
Storage subscription includes:
Secure cloud storage with AES-256 encryption
Unlimited VCF file downloads
Unlimited viewing of all reports
No download frequency restrictions
Backup and redundancy systems
24/7 data availability
What is NOT Included
The storage subscription does NOT include:
Initial whole genome sequencing kit (purchased separately)
Lifestyle report generation (purchased separately)
Additional genetic analysis or interpretations
Customer support beyond standard account assistance
Third-party application fees or services
When Subscription is Required
Initial 30-Day Free Period: You receive 30 days of free storage and access beginning when your VCF file results become available. During this period, no subscription is required.
After Free Period: A storage subscription is required to:
Continue downloading your VCF file.
Maintain an active (non-archived) status for your genetic data.
Access data without paying unarchiving fees
Without an active subscription, your VCF file will be automatically archived (and inaccessible for download), but reports will remain viewable at no additional cost.
Pricing and Payment
Subscription Price
Monthly Rate: $5.00 per month (USD)
Billing Frequency: Monthly, charged in advance
Taxes: Applicable sales tax added at checkout based on your location
Currency: All prices in U.S. Dollars
Payment Methods
We accept:
Credit cards: Visa, MasterCard, American Express, Discover
Digital wallets: PayPal, Apple Pay, Google Pay (where available)
Payment Processing
All payments processed through PCI DSS-compliant processors
We do not store complete credit card information.
Payment method may be authorized before charging.
Failed payments will result in multiple retry attempts over 7 days
Price Changes
Advance Notice: We will provide 60 days' advance notice via email to your registered email address for any price increases.
Your Options:
Accept the new price by continuing your subscription.
Cancel before the price increase takes effect (no penalties)
Cancellation will be effective at the end of your current billing period
Grandfathering: Current subscribers may maintain existing pricing for a minimum of 6 months after the price increase announcement.
Automatic Renewal and Billing
Automatic Renewal Terms
IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW
By subscribing, you explicitly consent to automatic renewal on a monthly basis until you cancel your subscription. Your payment method will be automatically charged $5.00 (plus applicable taxes) each month on the specified billing date.
Required Disclosures
Before You Subscribe, You Must Understand:
Your subscription will continue until you cancel it.
You will be charged automatically each month on your billing date.
You can cancel at any time through your account settings or by emailing support@mosaicbio.io
Cancellation takes effect at the end of your current billing period.
There are no cancellation fees or penalties
Consent to Automatic Renewal
By checking the subscription enrollment box and providing your payment information, you provide your express affirmative consent to:
Automatic monthly renewal of your storage subscription
Automatic monthly charges to your payment method
The terms and conditions set forth in these Storage Terms
Consent Record: We will retain verification of your consent for at least three (3) years or one (1) year after your subscription ends, whichever is longer, as required by law.
Annual Renewal Reminders
California Law Requirement: If you are a California resident, we will send you an annual reminder about your automatically renewing subscription via the same method you used to sign up (email). This reminder will include:
The product/service to which the subscription applies (Data Storage Service)
The frequency and amount of charges ($5.00/month plus applicable taxes)
How to cancel your subscription
Billing Cycle
Start Date: Subscription begins immediately upon enrollment
Billing Date: Charged on the same date each month
Pro-rated Charges: First partial month may be pro-rated
Time Zone: All billing dates calculated in Central Time (CT)
Failed Payment Handling
If Your Payment Fails:
First Attempt: We will retry the payment within 24 hours
Email Notification: You will receive immediate email notification of the failed payment
Additional Retries: We will attempt payment multiple times over 7 days
Service Suspension: After 7 days of failed payments, your subscription will be suspended, and your VCF file will be automatically archived
Reactivation: Update your payment method through account settings and reactivate your subscription at any time. You will not be charged for the suspension period.
Cancellation Process
How to Cancel - "Click to Cancel"
You Can Cancel Your Subscription at Any Time With No Penalties
Easy Cancellation Methods:
Online Cancellation (Recommended):
Go to Account Settings → Subscriptions
Click the "Cancel Subscription" button.
Confirm cancellation (one-click confirmation required)
Receive immediate email confirmation of Cancellation.
Subject line: "Cancel Storage Subscription"
Include: Your account email address.
We will process within one business day and send confirmation
Important: Cancellation is as easy as enrollment. We do not require phone calls, surveys, or multiple steps to cancel your subscription.
Cancellation Timing
When You Cancel: Any time before your next billing date
Effective Date: End of your current paid billing period
Access Continuation: You continue to have full access until the end of your paid period
No Refunds: No refunds for unused time in the current billing period
Automatic Renewal Stops: No further charges after your current period ends
What Happens After Cancellation
Immediate Effects:
Automatic renewal is disabled.
No future charges to your payment method
You receive an email confirmation of cancellation
After Current Period Ends:
Your VCF file is automatically archived (becomes inaccessible for download)
Reports remain viewable at no cost.
Account remains active
Genetic data remains securely stored per our Privacy Policy
Reactivation Option: You can reactivate your subscription or pay the $10 unarchiving fee at any time to regain access to your VCF file.
"Save Offers" During Cancellation
Allowed Save Offers: When you initiate cancellation, we may display:
Information about what you'll lose access to
A discount offer to retain your subscription
A reminder about the archiving process
Your Protection: Any save offer will be displayed alongside a prominent "Click to Cancel" or "Proceed with Cancellation" button, allowing you to complete cancellation immediately without engaging with the offer.
No Barriers: Save offers will not obstruct, delay, or prevent you from canceling immediately.

Target Uptime: 99.5% service availability
Planned Maintenance: We will provide advance notice of scheduled maintenance when possible. During maintenance, services may be temporarily unavailable.

Usage Restrictions
Prohibited Uses:
Using the service for commercial purposes without authorization
Sharing account credentials with unauthorized users
Attempting to circumvent billing or payment systems
Reverse engineering or copying our software or systems.
Violating applicable laws or regulations
Geographic Availability
Service Limitations:
Services are available in countries where we operate, and genetic testing is legal.
Local regulations may limit some features.
Compliance with local data protection laws is required.
Data is stored in U.S. data centers regardless of subscriber location

International Subscribers: Local consumer protection laws apply and may provide additional protections beyond these terms.

Formal Dispute Resolution
If informal resolution fails, disputes are subject to the dispute resolution procedures in our Terms of Service, including:

Limitation of Liability
Maximum Liability
Our Total Liability: Our total liability for any claims arising from your storage subscription is limited to the amount you paid for the subscription in the 12 months preceding the claim (maximum $60.00 for monthly subscribers).
Excluded Damages
We Are Not Liable For:
Service interruptions or downtime
Data access delays or technical issues
Third-party service failures
Indirect, incidental, or consequential damages
Lost profits or business opportunities
Emotional distress claims
Service Provided "As Is"
The storage subscription is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:
No warranty of uninterrupted service
No warranty of error-free operation
No warranty regarding data availability during force majeure events
Jurisdictional Variations: Some jurisdictions do not permit limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Termination
Your Right to Terminate
You may terminate your subscription at any time by following the cancellation procedures outlined in Section 5.
Our Right to Terminate
We may terminate or suspend your subscription if:
You breach these Storage Terms or our Terms of Service.
Your payment method fails repeatedly, and you do not update it.
We are required to do so by law or regulation.
We discontinue the storage subscription service (with 90 days' notice and a pro-rated refund)
Effects of Termination
Upon termination:
Automatic renewal stops immediately.
You retain access through the end of your paid period.
The VCF file is archived after the paid period ends (unless reactivated)
Reports remain viewable at no cost.
Genetic data retained per Genetic Data Consent Notice
Sections 10, 11, 12, and 16 survive termination
Miscellaneous
Entire Agreement
These Storage Terms, together with our Terms of Service, Privacy Policy, Genetic Data Consent Notice, Kit Order Terms and Conditions, Disclaimer Policy, and Cookie Policy, constitute the complete agreement regarding your storage subscription.
Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
No Waiver
Our failure to enforce any right does not constitute a waiver of that right.
Assignment
You may not assign your subscription or these Storage Terms to any third party. We may assign our rights and obligations without notice.
Force Majeure
Neither party shall be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, pandemics, government actions, infrastructure failures, or supplier issues. During such events, we will make reasonable efforts to minimize disruption and may extend deadlines or suspend performance as necessary.
